Transfer of Prisoners
Transfer of prisoners agreements have been reached with members of the Council of Europe and UK, and are being made with Thailand. Arrangements for these agreements to be extended beyond 1997 require
discussions with the Chinese
side.
It is planned that the
talks with the Chinese side on the transfer of prisoners should take place after the talks on rendition have completed. (no change since last submission)
Crimes Ordinance
There are several aspects of the Crimes Ordinance that require review
(a)
Parts 1 and 2, which deal with treason and other offences against the Crown need amendment by 1997;
Review of parts 1 and 2 together with the official Secrets Act (see below) will be undertaken by Security Branch in conjunction with Attorney
General's Chambers and General Duties Branch.
Review of the death penalty will also be necessary.
