Section 23 is amended by adding after subsection (1) -
" (1A) For the purposes of an election in any constituency
in respect of the Legislative Council, the Governor may appoint
a returning officer for that constituency and such number of
assistant returning officers as he thinks fit.".
13.
Section substituted
Section 24 is repealed and the following substituted
"24.
Supervision of elections
(1) A returning officer shall, subject to this Ordinance,
supervise the election in the constituency or District for
which he is appointed.
(2) No by-election to fill a vacancy in a constituency in
respect of the Urban Council, the Regional Council or a
District Board, as the case may be, shall be held within the 3
months preceding the date on which an ordinary election in
respect of that Council or Board respectively is to be held,
and any such vacancy shall be filled at that ordinary election
or at a by-election held in lieu thereof if such ordinary
election for the constituency concerned is countermanded in
accordance with regulations made under section 28.".
14.
Penalties concerning conduct of elections
(1)
Section 27 is renumbered as subsection (1).
(2) Section 27 is amended by adding after subsection (1)
"(2) No prosecution for an offence under subsection (1)
shall be instituted without the consent of the Attorney
General.".
