Referrals of Appointments, Promotions etc. to the Secretary of State

(I) Purpose

This paper examines the proposal

by the

Hong Kong Department of FCO to reduce to the absolute

minimum referrals of appointments, promotions etc. to

the Secretary of State.

(II) Background

A list of appointment and promotion matters

are made to the Secretary of State

on which referrals

is set out in Appendix A.

The main basis for such referrals is provided

in Colonial Regulations 19 which states that -

"The selection of a candidate for any

appointment the initial basic salary of which

not less than either £1,000 or

any other

higher figure prescribed by the Secretary of

State in respect of any particular territory,

shall be subject to the approval of the

Secretary of State. When a vacancy occurs in

such a post the Governor shall report it to

Secretary of State. The Governor may

recommend a candidate to fill the vacancy,

but it shall be clearly understood that the

Secretary of State may select another

candidate."
