Negotiation of bilateral agreements on the lines of the

model agreement at Annex A will be time-consuming. The British side plans therefore that Hong Kong should begin negotiating bilateral agreements soon.

THE MODEL AGREEMENT (Annex A)

The model agreement at Annex A is very similar to

existing agreements

which

have

been

accepted

internationally although these do not at present extend to

Hong Kong. It sets out clearly the circumstances when

assistance shall be provided and,

conversely, the

circumstances when, in the

interests

of justice,

assistance shall or may be refused.

Scope of Assistance Article 1

Assistance shall include:

(a)

identifying and locating persons;

(b)

serving documents;

(c)

obtaining evidence;

(d)

conducting searches and seizures;

(e)

facilitating the appearance of witnesses in the

requesting jurisdiction;
