I refer to my minute of 5 September to Mr Edwards.
He agrees with the general conclusions in that minute, and thinks that we should now approach the Charity Commissioners. If you agree, I will write to the Charity Commissioners in terms of the attached draft, copying to them my minute to Mr Edwards, and the papers you prepared. I will ask them for advice on whether a trust exists, and how we should now proceed. Unless you see any objection, I would propose copying that letter and my minute (but not the enclosures) to Mr Martin Davidson at the British Council, and Mr Michael Briegel at the Institute of Cancer Research (see Flags H and I).
3. Before I can write to the Charity Commissioners, however, I will need HKD's authority to remove the classifications from the items at Flags C, D, F, K, L, M, N, 0, Q, R, T and V. I should perhaps say that I am not clear why these papers should bear a classification, as opposed to a Confidence marking. It would also be useful to have a further four copies of the bundle of papers which you prepared, flagged up in the same way. (Before we send the papers to the Charity Commissioners, you may wish to check that they contain nothing which you would prefer to keep within the Office.)
4. I do not think we need to go back to the authorities in Hong Kong yet; they can be brought in once we have advice from the Charity Commissioners, who may, in any event, ask for further information or a view on the law in Hong Kong.

5. Could we try to take this forward fairly quickly? would like to write to the Charity Commissioners within the next week or so.
