BETWEEN His Excellency Sir Alexander William George

Herder Grantham Knight Grand-Cross of the Most Distinguished

Order of Saint Michael and Saint George Governor and

Commander-in-Chief of the Colony of Hong Kong and its

dependencies and Vice Admiral of the same (hereinafter

referred to as "His Excellency") of the one part and

The Imperial War Graves Commission of 32 Grosvenor:

Gardens in the County of London a body constituted by

Royal Charter (hereinafter referred to as "the Commission")

of the other part WHEREAS HIS Excellency has agreed to set

aside in the name of the Commission an area of

approximately two hundred and sixty-three thousand two

hundred and sixty square feet at Sai Wan in the said

Colony for the purpose of a Cemetery for the burial of

Members of the Forces of the British Commonwealth fallen

in the war of 1939/45 (and of Hembers of the Forces of

His Majesty's Allies whose remains also lie therein) AND

WHEREAS it has been agreed that in lieu of granting

Lease thereof to the Commission the same shall remain

vested in the Crown but together with the usual appur

tenances thereto shall be exclusively and in perpetuity.
