(3) Rules made under this section may provide that the amount

of any fees or other charges may be fixed by reference to a scale

prescribed in the rules, and for the payment of different fees or

other charges by or in relation to persons or cases of different

classes or descriptions.

MISCELLANEOUS

Injunctions to restrain contraventions

51. (1) If on the application of the Commission the High Court

is satisfied that there is a reasonable likelihood that any person

will contravene any provision of any rules or direction made or given.

under section 26 or 27 or any notice under Part V, the court may

grant an injunction restraining the contravention or, as the case may

be, make an order that any person who appears to the court to have

been knowingly concerned in the contravention take such steps as the

High Court may direct.

(2) No application shall be made by the Commission under

subsection (1) for an order affecting any person who is a member of

an Exchange Company unless the Commission has given written

notification of its intention to that Exchange Company.

Actions for damages

52. (1)

Without prejudice to section 51, a contravention of

any financial resources rules or any notice under Part V shall be

actionable at the suit of a person who suffers loss as a result of

the contravention.
