facts capable of being disclosed by the record or other document.
Powers of intervention
35. (1) Any power conferred on the Commission by section 36,
37 or 38 shall be exercisable in relation to any registered person
if, and only if, it appears to the Commission that -
(a)
the exercise of the power is desirable in the interest of
the investing public;
(b)
the registered person is not a fit and proper person
(having regard, amongst other matters, to the matters
specified in section 21(3)) to carry on any one or more of
the businesses in respect of which he is registered under
the Securities Ordinance (Cap. 333) or the Commodities
Trading Ordinance (Cap. 250), as the case may be, to the
extent to which he is carrying it on or proposes to carry
it on; or
(c)
the registered person has contravened or failed to comply
with any provision of or requirement under the relevant
Ordinances or, in purported compliance with any such
provision, has furnished the Commission with information
which is false, inaccurate or misleading.
