Service of documents

It is important that service abroad of

documents issued in Hong Kong can be

ensured. It is proposed that

arrangements which Hong Kong enters

into will

i)

be reciprocal;

ii)

iii)

ensure service of documents in

the form required by the law of

the requesting country; and

provide a clear obligation on the

requesting country not to impose

any penalty or coercive measure

on a person who does not respond

to a document served.

c)

Obtaining evidence

Evidence may already be taken in Hong

Kong for transmission to a requesting

country for use in criminal proceedings

which have been instituted or whose

institution is likely if the evidence

is obtained. However, Hong Kong is not

guaranteed reciprocity
