In exceptional cases where the return of an individual or family

to the place of origin may prove not to be in the best interest

of the returnee, a suitable alternative place will be identified

upon consultations between the returnee concerned, the SRV and

UNHCR. The ultimate choice of the place of installation will be

in accordance with paragraph 3(b) of the Memorandum. However,

lack of decision with respect to place of installation of an

applicant shall not prevent the authorities from issuing

authorisation of return to the country to the applicant

concerned.

In the case of unaccompanied minors under 18 years of age who

return to Vietnam under present arrangements, the SRV

authorities would notify the parent(s), next of kin or guardian,

sufficiently in advance before the date of repatriation.

Parent(s), next of kin or guardian will be encouraged to take

immediate custody of such minors. The principle stated in

paragraph 3(a) of the Memorandum would apply also to parent(s),

next of kin or guardian of such persons. With the agreement of

the SRV, the UNHCR counselling staff may speak to the parent(s),

next of kin or guardian of such minors in order inter-alia to

assess whether the family may be in need of some material

assistance on strictly humanitarian grounds.
