Suggested Solution

(a) We suggest adding the following

sub-article to Art. 52:

"When a motion of impeachment is passed by the Legislative Council in accordance with Art. 72(9) and is upheld by the CPG."

(b)

As drafted, Art. 64 limits the accountability of the SARG to the legislature to only the four areas specified in the Article. This is regarded as inadequate.

(b) Art. 64 be revised as:

"The Government of the Hong Kong SAR shall abide by the law and shall be accountable to the Legislative Council of the Region for matters which the HKSAR administers on its own in accordance with this Law."
