COURT OF APPEAL SUPREME COURT HONG KONG

I refer to the Chief Justice's letter to you dated the 3rd. A copy of it was handed to me yesterday afternoon.

With diffidence and with the greatest respect to the Chief Justice, I make the following comments on his letter:

Para. 2. Whilst Mr. Justice Barker did not give the appearance of telling an untruth,.I cannot go so far as to say his denial seems convincing. All that I can say about business cards (which I would have called visiting cards) is that some judges have them and some do not: I have). As to the shop-owner's non-production of Mr. Justice Barker's card, my information is that the shop-owner was unable to find it.

Para. 3. My view is that mistaken identity, though not impossible, is unlikely, for the photograph identification seems convincing.

Para. 4. I do not know whether there is substance in the suggestion that Mr. Justice Barker went to the radio shop with Rogerio Lam. It all depends on the evidence which the ICAC has gathered.
