An Agreement between the People's Republic of Poland and the People's
Republic of China on Civil and Criminal Judicial Assistance
The People's Republic of Poland and the People's Republic of
China have decided to conclude this Ageement on the basis of respecting
national sovereignty, independence, equality and mutual benefit, and for
the sake of strengthening the friendly and co-operative relationship
between the two countries in judicial fields. For this purpose, they
have agreed on the following provisions :
Chapter 1
GENERAL PROVISIONS
Article 1 Judicial Protection
The nationals of one contracting party when present in
the territories of the other contracting party, shall enjoy the same
judicial protection as the nationals of the other contracting party,
and are entitled to take legal proceedings or make requests in the
courts or other institutions of the other contracting party on the same
conditions governing the nationals of the other contracting party.
Article 2 Exemption from Deposits of Costs
The courts and the other competent authorities in charge of
civil matters of a contracting party shall not require the nationals of
the other contracting party who maintain place of abode or residence.
within the territories of the other contracting party to tender deposits
of costs in civil proceedings.
Article 3 Advance Payment of Costs
The nationals of a contracting party shall, within the
territories of the other contracting party, effect advance payment of
costs in civil proceedings on the same conditions and within the same
scope as the nationals of the other contracting party.
