The same allegations mentioned in paragraph 10 above were again made by the same member to OMELCO on 4 December 1987. After careful consideration of the relevant facts, OMELCO has decided that the allegations relating to mishandling of the matter and collusion were unfounded and did not see fit to intervene with SMS's exercise of statutory responsibility.

The Antiquities Authority is required by law to decide before 26 December 1987 whether the application to withdraw the declaration should be acceded to. Having regard

to

(a)

that, against the background of the proposal and the owners' right to

right to redevelop the site, the reconstruction proposal is the best compromise achievable;

the improved religious and recreational facilities which will be provided to the Jewish Community by reconstruction of the Synagogue and redevelopment of the site;

(c) the spirit of preservation which, in this case, requires the retention of the symbol of the Jewish Community presence in the history of Hong Kong, which can be satisfied by reconstruction of the Synagogue to its authentic design and dimensions;

(d) the traditional respect for the religious communities to modify places of worship;

(e)

freedom of
