Lord Winchilsea's letter follows up an earlier exchange between him and Mr Eggar (in Lord Glenarthur's absence on holiday). Those letters are attached, together with Mr Smith's submission of
20 August.
4.
Lord Winchilsea's latest letter is more detailed and carefully argued than his first. It seeks assurances and guarantees which we are simply not in a position to offer. The attached analysis from the Department's Legal Adviser explains why this is so. In the circumstances I consider that we have no alternative but to make this plain to Lord Winchilsea, while emphasising that:
