Explanatory Memorandum

This Bill is consequential to the Control of Publications Consolidation (Amendment) Bill 1986 which repeals certain provisions relating to the control and suppression of newspapers.

2. Section 6 of the Control of Publications Consolidation Ordinance (Cap. 268) is to be repealed and relates to the publication of false news which is likely to alarm public opinion or disturb public order. This provision is more appropriate to the Public Order Ordinance (Cap. 245) and clause 2 of the Bill, therefore, reproduces (in an amended form) section 6 of Chapter 268 as a new section 27 of the principal Ordinance.

3. The opportunity is also taken by clause 2 of the Bill to replace the existing section 30 of the principal Ordinance (introduced in 1972 and designed, although not specifically, to deal with bomb hoaxes) with a new section 28. This new section is based upon section 51 of the Criminal Law Act 1977 of the United Kingdom and specifically deals with the problem of bomb hoaxes.

4. The Bill has no financial or Public Service staffing implications.

一九八六年公安(修訂)條例草案

摘要說明

本條例草案是繼一九八六年刊物管制綜合(修訂)條例草案而制定的,因 為後者撤銷若干與管制及查禁報刊有關的條文。

刊物管制綜合條例(香港法例第二六八章)第六條將予撤銷,該條條文是 與報導可能引起輿論恐慌或擾亂公安的虚假消息有關。這條條文附列在公安條例 (香港法例第二四五章)內將更為合適,因此,本草案第二條以修訂方式重新制定香 港法例第二六八章第六條條文,並把它列為原有條例新訂的第二十七條條文。

三、 本草案第二條亦藉此機會以新訂的第二十八條條文取代原有條例中現有 的第三十條(該現有條文在一九七二年實施,內容涉及處理炸彈虛報問題,雖則該 條文並非特別爲這目的而制定)。該新訂條文是以英國一九七七年刑事法第五十一 條為藍本,並且特別針對炸彈虛報問題而制定。

四、 本草案對政府開支和人手需求方面都没有影響。
