Dentists (Registration and Disciplinary Procedure) Regulations

Regulation 12 is amended--
(a) in paragraph (1)(b) by deleting "or (ba)” and
substituting the following-
", (ba) or (c)"; and
(b) in paragraph (4)(c) by deleting “or (ba)” and
substituting the following—

The Second Schedule is amended by inserting, before the last item, the following-
"Practising certificate for a person deemed to be a registered dentist under section 30(3)(a)
Explanatory Memorandum
The main objects of this Bill are—
$ 25".
(a) to amend the law relating to dentists' qualification for registration; (b) to provide that the full-time teaching staff of the Faculty of
Dentistry of the University of Hong Kong are deemed to be registered dentists and exempt from registration;
(c) to expand membership of the Dental Council and the Preliminary
Investigation Committee; and
(d) to remove restrictions on eligibility for election as the acting
chairman of Dental Council meetings.
2. Clause 2(a) amends section 4 of the principal Ordinance to include in the composition of the Dental Council of Hong Kong dentists registered under section 8(1)(c). The effect of the amendment in clause 2(b) is that, in the absence of the chairman, any member present at a meeting is eligible for election as the chairman of the meeting.
3. Clause 3 amends section 8(1)(ba)(i) of the principal Ordinance to enable dentists who hold qualifications obtained in the United Kingdom or Commonwealth but not recognized by the General Dental Council of the United Kingdom to be registered under section 8(1)(ba) if the qualifications are recognized by the Dental Council of Hong Kong.

The amendments in clause 4 will require persons on the full-time teaching staff of the Faculty of Dentistry of the University of Hong Kong to obtain practising certificates notwithstanding that they are deemed to be registered by virtue of the new subsection (3)(a) in section 30. Clause 5 contains consequential amendments in respect of recovery of practising fees.

Clause 7 amends section 26 to enable due recognition to be given to dentists who have satisfied the Dental Council that they should be registered under section 8(1)(c). They may use titles or descriptions asso- ciated with their academic qualifications.
6. By virtue of the new subsection inserted by clause 8 into section 30 of the principal Ordinance, persons on the full-time teaching staff of the Faculty of Dentistry of the University of Hong Kong are deemed to be registered dentists and exempt from registration whilst not being denied their entitlement to registration and exemption from payment if they are
qualified to be registered under section 8. In consequence of the new Jubsection, amendments are made in clauses 6 and 9 to section 25 and section 31 respectively.
7. Consequential amendments are made in clause 10 to other Ordi- nances and the subsidiary legislation under the principal Ordinance.
8. The Bill has no Public Service staffing or public expenditure implications.

本條例草案的主要目的如下:

修訂有關牙醫註冊資格的法律;
(b)
規定香港大學牙醫學院的全職教員視為註冊牙醫,並獲得豁免註冊;
(c)
擴大香港牙醫管理委員會和初步偵訊小組的成員組織;以及
(d)
撤銷選舉香港牙醫管理委員會會議署理主席的資格限制。

草案第2(a)條修訂原有條例第4條,將根據第8(1)(c)條註冊的牙醫,包 括在香港牙醫管理委員會成員之列。草案第2(b)條所作修訂的作用是,當主席缺席 時,出席會議的任何成員都有資格被選為該次會議的主席。
3. 草案第3條修訂原有條例第8(1)(ba)(i)條,規定凡在英國或英聯邦國家 獲得牙醫資格而又不獲英國牙醫總會承認的人士,倘其資格獲香港牙醫管理委員會 承認,則可根據第8(1)(b)條註冊為牙醫。
4. 草案第4條所作的修訂規定,雖然根據原有條例第30條新訂第 (3)(a)款,香港大學牙醫學院的全職教員視為註冊牙醫,但他們必須領取執業證 書。草案第5條就收回執業費一事,作出相應修訂。
5. 草案第7條修訂原有條例第26條,使符合香港牙醫管理委員會的規定 而可根據第8(1)(c)條註冊的牙醫,獲得適當承認。上述牙醫可使用與其學歷有關的 名銜或描述。
6. 草案第8條在原有條例第30條加入一新訂款,以規定:香港大學牙醫 學院的全職教員為註冊牙醫,並獲得豁免註冊,若他們具備資格根據原有條例第 8條註冊為牙醫,則仍享有註册和免交費用的權利。由於上述新訂款的規定,草案 第6和第9條分別對原有條例第25和31條作出修訂。
7.
草案第10條對原有條例的附屬法例和其他條例,作出相應修訂。
8. 本草案對政府人手和公共開支,均無影響。
