(b) if he has less than six weeks'
earned leave (including any deferred leave) standing to his credit on the date he ceases duty with the Hong Kong Government, he will be granted additional leave to bring his period of leave up to a total of six weeks;
(c) if he is not already eligible for them and has not already received
them he will receive full retirement passages and baggage concessions.
The decision as to whether or not a particular retirement falls within the terms of this paragraph will rest with the Governor.
Death of an Eligible Officer
23.
The dependants or the legal personal respresentatives of an eligible officer who has been directed or given permission to retire under this Scheme and who dies while still serving (or while on leave prior to retirement) and before payment of the compensation due to him has been made, will receive the compensation and the death gratuity for which provision is made in the Hong Kong pensions legislation, provided that the death gratuity shall, where applicable, be calculated by reference to the special table of factors provided for in paragraph 24 below.
Commutation of Pensions
24.
Eligible officers retiring under this Scheme shall be entitled to commute the fraction of their earned Hong Kong pension stipulated in the Hong Kong pensions legislation applicable to them in accordance with the special commutation factors set out in Table III in the Appendix.
Employment During Retirement Leave
25.
An eligible officer who wishes to take up any paid employment while on leave pending retirement may accept such employment without obtaining the prior sanction of the Governor or the Secretary of State with the exception that the prior approval of the Governor must be obtained if the employment is employment in Hong Kong or is as a director of any company the principal part of whose business is in any way directly connected with Hong Kong.
