An eligible officer who is required to retire in accordance with the provisions of sub-paragraphs (c), (d) or (e) of paragraph 2 and who is offered and accepts re-employment by the Hong Kong Government or a subvented organisation which is determined to be "public service" for the purposes of this paragraph will not be eligible for compensation except that where the salary of the new appointment is lower than that of the post from which he was required to retire he will be eligible for compensation calculated at the factors applicable to an officer who is superseded for promotion in the interests of localisation on the difference between the emoluments of the two appointments.

Subject to the provisions of paragraphs 12 and 13 above compensation shall be calculated by multiplying the officer's annual pensionable emoluments as defined in the pensions law at the date taken for calculation by the factor appropriate to his age and length of service at that date.

The date taken for calculation shall be the date when the officer retires, or in the case of an officer who is an eligible officer under the provisions of sub-paragraph (a) of paragraph 2, the date on which the officer is superseded for promotion as advised by the Public Service Commission.

Service (whether under the Hong Kong Government or under a "Scheduled Government") shall count for compensation to the same extent as it counts in the computation of the officer's retirement benefits.

The pensionable emoluments to be taken for calculation will be the full annual pensionable emoluments which the officer is enjoying on the date taken for calculation. (For the purpose of calculating the lump sum compensation in paragraph 11 above, the pensionable emoluments will be taken as if the officer is on 100% pensionability.) An eligible officer acting in a post in a higher rank which is required for localisation and which is vacant otherwise than by the temporary absence of its substantive holder and who whilst so acting retires under this Scheme will be confirmed as the substantive holder of a post in that rank so that the pensionable emoluments in that rank will be the pensionable emoluments on which his benefits under the Scheme will be calculated, providing that he has so acted for a period of not less than six months during the preceding nine months to the satisfaction of the Government. If the substantive holder of the post in a higher rank is on pre-retirement leave, this sub-paragraph shall apply to any eligible officer acting in the post in that period or part of it.
18.
The Tables shall be interpreted on the basis of completed months of age and service.
