(e) may, on the direction of the

Governor, be required to retire under the compensation scheme in the interest of the development of the public service.

These officers are referred to hereinafter as "eligible officers" for the purpose of this Scheme.

Officers who have reached the normal age of retirement as prescribed under the appropriate law, officers seconded or temporarily transferred to Hong Kong from other public service and officers on leave pending retirement on the "operative date" shall not be eligible officers.

If an officer serving on probation, who is otherwise an eligible officer within the meaning of paragraph 2, is required to retire, that officer will, on being directed to retire by the Governor, be confirmed in his appointment forthwith and shall be entitled to compensation and other appropriate benefits provided for in this Scheme.

Eligibility for Retirement Benefits

The effect of the Scheme on retirement benefits, having regard to the provisions of the Pensions Laws in Hong Kong and in other territories, is as follows.

Any officer who is an eligible officer within the meaning of sub-paragraphs (b), (c), (d) and (e) of paragraph 2 who retires from the pensionable service under this Scheme will be eligible to receive from the date of his retirement such retirement benefits from the Government of Hong Kong as he has earned by his pensionable service in Hong Kong irrespective of whether his length of service in Hong Kong is less than ten years and of whether he has attained the minimum retiring age at the date of his retirement.

Any officer who is an eligible officer within the meaning of sub-paragraph (a) of paragraph 2 who retires from pensionable service under this Scheme will be eligible to receive from the date of his retirement the commuted fraction of his earned Hong Kong pension stipulated in the Hong Kong pension legislation, irrespective of whether he has attained the minimum retiring age, and will be eligible to receive the balance of the pension earned by his pensionable service in Hong Kong with effect from a date five years before the normal retiring age specified in the pensions legislation applicable to him.
