HONG KONG
COMPENSATION SCHEME FOR CERTAIN PENSIONABLE OFFICERS
Effective Date of the Scheme
1.
The Scheme shall come into operation with effect from 1 January 1985 (hereinafter referred to as the "operative date").
Definition of Officers to Whom
the Compensation Scheme Applies

Pensionable officers, other than Judges of the Supreme and District Courts, selected for appointment before the "operative date" (including officers appointed on agreement terms before the operative date who
subsequently transfer to pensionable terms without a break in service before or after the operative date) :-
(a) shall be compensated under the
Compensation Scheme if the Public Service Commission, or Judicial Service Commission advises that they have been directly superseded for promotion to a normal vacancy (i.e. not one specifically created by a premature retirement to facilitate localisation) by local officers in pursuance of a policy of giving preference to local officers in promotion and may, with the
permission of the Governor, retire under the Compensation Scheme
(Note: promotion means promotion to a rank in the same grade);
(b) may retire under the Compensation Scheme with the permission of the Governor if he is satisfied that circumstances exist which make it unreasonable for the officer to continue in the service;
(c) may, on the direction of the
Governor, be required to retire
under the Compensation Scheme in the interest of localisation;
(d) may, on the direction of the
Governor, be required to retire under the Compensation Scheme to facilitate constitutional change.
