recommendations to Civil Service Branch for processing. The officer concerned will be informed in writing of the direction to retire.

12.

Applications

for

retirement

grounds

following supersession of promotion or

that circumstances exist which make it unreasonable for an officer to continue his service should also be directed to the Civil Service Branch.

Normally, there should be a six-months' notice period for retirement under the Compensation Scheme, but a shorter notice period may be accepted by mutual agreement between the officer and the Government.

Officers accepting further employment after retirement

In accordance with paragraph 13 of Annex A an officer who is required to retire and who is offered and

re-employment by accepts

the Hong Kong Government or a subvented organisation as defined under this Scheme will only be eligible for compensation where the salary of the new appointment is lower than that of the post

the post formerly held. In this event, the compensation is calculated at the factors applicable to an officer who is superseded for promotion in the interest of localisation having regard to the difference between the salaries of the two appointments. In the following circumstances the compensation payable may be re-calculated when the officer finally leaves the public

service -

(a)

(b)

where the officer ceases to hold the appointment of lower salary other than at his own wish before his date of normal retirement; or

where employment after retirement is in two or more posts all at a lower

level.

In either case the salary difference will be calculated on the basis of the average annual salary received over the period between the actual date of retirement and the normal date of retirement, provided that the rates of salaries prevailing at the date of actual retirement will be used to calculate the average annual salary received. The factor to be used in the recalculation will be that used for the original calculation.
