the pool of local officers to groom local staff for the senior ranks, the order of priority of officers recommended for promotion will be adjusted according to their terms of appointment. Annex B illustrates how the adjustments will be made.

The findings and recommendations of promotion exercises involving officers other than judicial officers should be forwarded to the Civil Service Branch who will arrange, where appropriate, for advice to be sought from the Public Service Commission. For judicial officers, the Judiciary will refer the recommendations to the Judicial Service Commission for advice.

Upon approval of the recommendations for promotion by the relevant authority, any overseas officer who is superseded for promotion by a local officer as a result of adjustment of the order of priority on grounds of his terms of appointment will be informed in writing.

He will then be eligible for compensation under the terms of the Compensation Scheme.

Any appeal against the outcome of a promotion exercise from an officer other than a judicial officer may be directed to Civil Service Branch and arrangements will be made for advice to be sought from the Public Service Commission. Alternatively, the officer may make direct representations to the Public Service Commission in accordance with CSR 493. An appeal from a judicial officer will be dealt with by the Judiciary and advice from the Judicial Service Commission will be sought.

An officer who has been

been superseded and who has been compensated accordingly may remain in the service, but will not be considered in future promotion exercises to the higher rank. An officer who has been supersedea, has the right to decline compensation and to be considered in future promotion exercises. However, if the officer is again superseded on grounds of localisation in a future promotion exercise ΟΙ exercises, the compensation he will receive will be the amount for which he is eligible in that exercise.

Where an officer is required to retire in the interests of localisation or the development of the public service, or to retire to
