retirement of an officer on redundancy i.e. on abolition of office or

re-organisation of the department to effect greater efficiency;

death of an officer in service who had completed between 5 and 22.5 years pensionable service; and

injury of an officer while on duty.

(1) Suspension, cancellation or reduction of pensions

The Governor may suspend, cancel or reduce pension in the circumstances set out in Annex A(iii).

(J) 90% and 100% pensionability

Serving officers who are on 90% pensionability may opt to transfer to 100% pensionability on joining the NPS. Officers who so opt will have their pension benefits calculated on the basis of 100% of their pensionability in respect of service as from a material date to be determined in the manner set out in Annex D.

(K) Extension of service

As a general rule, extension of service beyond the retirement age set out in paragraph A(i) and (iii) above will not be allowed in the normal circumstances. However, an officer who has attained maximum pension status before reaching the age of 60 years may retire from the pensionable service and be immediately re-employed in the same rank on gratuity bearing terms until the day before his 60th birthday.

He may receive his commuted pension gratuity on retirement but his monthly pension will be suspended during his re-employment service. His re-employment service will not count for any additional benefits under the Pension Benefits Ordinance 1987 and Pension Benefits Regulations 1987.

(L) Subject to the provision of the Pension Benefits

Ordinance 1987 and the Pension Benefits Regulations 1987, pension benefits are paid as of right.
