TRANSFER TO A SUBSIDIARY OF PART OF THE CONCESSION AND UNDERTAKING OF HONG KONG TELEPHONE COMPANY

Introduction

On 23 November 1982, after considering nemorandum XCC(82)141, Members advised and the Governor ordered that certain changes should be made to the Scheme of Control applied to the Hong Kong Telephone Company Limited (Telco). Amongst these changes was the exclusion from the Scheme of Control of certain services which are

exclusive not

to Telco, that is, those which can be obtained by the public elsewhere or are not an essential part of the telephone service.

Members' consent under the provisions of the Telephone Ordinance for the transfer by Telco to a subsidiary

Telco's concession and undertaking related to services to be excluded from its Scheme of Control.

The proposal that the Scheme of Control should apply only

only to those activities which form part of the public telecommunication system and are provided exclusively by Telco was approved on certain conditions, including a condition that the services excluded from the Scheme of Control should be carried out by a subsidiary of Telco rather than by Telco itself.
