2. If Legal Advisers agree that Hong Kong, as an associate member, can accredit a permanent representative to the IMO, then they would have to "make known in writing to the Secretary-General the name and rank of the person designated for that purpose" (Annex to Exchange of Notes of 20 January 1982; Mise No 7 (1982), Cmnd 8495). The Secretary-General shall then notify HMG (paragraph 4 of Part IV bis Permanent Representatives Article 13 bis, of the Headquarters Agreement). Protocol Department would then consult HKD, MAED and PUSD and, if nothing detrimental arose, would "note" the appointment.
3. Paragraph 5 of the latter reference precludes, inter alia, CUKCs from enjoying the privileges and immunities normally enjoyed by Permanent Representatives. As Hong Kong telno 4297 states that the permanent representative designate is a British citizen it would seem that the question of privileges and immunities does not arise.
