2. Frank Wall (DTp) has spoken to Mr Mensah (IMO Assistant Secretary-General) who has confirmed that he sees no difficulty either constitutionally or legally in

Hong Kong appointing a permanent representative. He did however envisage problems should Hong Kong wish to establish a mission.

3. Mr Mensah reminded Mr Wall of para 2(5) of Article 13 bis of the IMO HQ Agreement which stipulates that no (then) CUKE could enjoy immunities and privileges. Mr Milburn has also noted this in his minute to you of 7 January.

4. Once news of the proposed appointment became known Mr Mensah expected to have to explain the IMO position to Capt Shi of the PRC Embassy who if passed form was anything to go by - would be seeking an early appointment.
