Amend the Roads (Works. Use and Compensation) Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the

Legislative Council thereof.

1. This Ordinance may be cited as the Roads (Works, Use and Compensation) Short title. (Amendment) Ordinance 1987.

2. Section 17(1) of the principal Ordinance is amended by deleting paragraphs Amendment of (a) and (b) and substituting the following---

"(a) direct that the road or part thereof shall be closed;

(b) direct that the Crown foreshore or sea-bed shall be reclaimed;".

3. Section 36 of the principal Ordinance is amended in paragraph (a) by Amendment of deleting", authorized”.

Explanatory Memorandum

This Bill amends section 17 of the Roads (Works, Use and Compensation) Ordinance in respect of orders for the closure of roads and for the reclamation of Crown foreshore or sea-bed. At present, for any such closure or reclamation to be effected, the Governor must first authorize the Secretary for Transport. The amend- ment enables the Governor or his delegate to direct the closure or reclamation.

一九八六年道路(工程、使用及賠償)(修訂)條例草案

摘要說明

本條例草案對道路(工程、使用及賠償)條例第十七條有關封閉道路及在 政府海灘或海床進行填海的命令,作出修訂。現時,凡封閉道路或填海,須先由總 督授權運輸司進行。本項修訂,使總督或其代表有權直接下令封閉道路或填海。

二、 本草案並對原有條例第三十六條作出因應的修訂。

三、 本草案對政府人手需求和財政方面都没有影響。
