MR MOTTRAM: With all due respect, surely when a contractor puts in a bid for any building or any development

he must always be aware that he should construct in accordance

with the specification which he has tendered for. I think we have made the point, I am not quite sure in which paragraph, but if the

contractor had any doubts at the tender stage, as indeed some

contractors do, they put in a proviso in the tender, that, yes, they think they could do this job but they suggest that the job might be done better or an alternative method might be done at such and such a price. This contractor did not.

CHAIRMAN: Your point is not only this contractor but all the submissions for tender did not put in a proviso ?

MR MOTTRAM:

As far as we are aware, yes.

Was it your responsibility to ensure that the work was done properly in

accordance with the terms of the contract ? I understand that in
