I think it is a balance really. Of course

it depends upon the degree and the quantity of GIC or open space provision which he has to take on in relation to the value of his

12 development. There will come a stage where a development is not

economic. In applying these, in insisting on provision of these things, the development becomes less economic obviously the more he

is required to provide. You must remember that particular in those

16 cases you are talking about where you have got individual lots, you

are dealing very often with people who don't actually require modification, who have had virtually unrestricted leases, and so,

you know, the requirement to provide if, but for the Town Planning zoning, they would be able to go straight up and not worry about

GIC. An outside body comes along, quite rightly, and decides that such and such a lot is to be used for public use. Seen from the developer's

23 point of view, it is something he can't do anything about except object. His objection is turned down. He appeals, it is still turned down. So, I mean, the next thing he'll try is the Section 16 permission.
