But in the cases where you described that
the developer or the owner of the land were to have to apply to the
Town Planning Board under Section 16 for change of use or from a
4 zoning of either open space or GIC into the possibility of allowing

that particular land to be developed and the profit thus accrue to
the developers themselves, in those cases surely there is no case
for the developers to feel that they have been aggrieved?
SLW:
I think it is a balance really. Of course

it depends upon the degree and the quantity of GIC or open space provision which he has to take on in relation to the value of his
12 development. There will come a stage where a development is not

economic. In applying these, in insisting on provision of these things, the development becomes less economic obviously the more he
is required to provide. You must remember that particular in those
16 cases you are talking about where you have got individual lots, you
are dealing very often with people who don't actually require modification, who have had virtually unrestricted leases, and so,
you know, the requirement to provide if, but for the Town Planning zoning, they would be able to go straight up and not worry about
GIC. An outside body comes along, quite rightly, and decides that such and such a lot is to be used for public use. Seen from the developer's

And

it really depends upon the amount of facility you wish to impose upon hir
as to where he stands in relation to his investment in the lot in the
first place.

something that I think the developer is very well aware of, the requirement of providing GIC facilities, to have a major development
project such as Hung Hom dockyard. I have a question also in
