transfer a licence under section 18A(5) will take
effect forthwith notwithstanding that an appeal is
lodged against such refusal. In other words section
31(3) shall not apply in such a case.

Clause 15 amends the regulation-making section
43 to enable regulations to be made regarding the annual
charge under the new sections 15A (clause 4) and 26A
clause 11), and providing an hourly or daily penalty
for continuing offences under specified regulations.
13. Clause 17 inserts in the Third Schedule to
the principal Ordinance the premises in Tai Po Area 26
used for gas works to exclude such premises from the
exemption provisions of section 20.

Clause 18 amends the Fourth Schedule to the
principal Ordinance to provide for the reference of
disputed claims under the Ordinance to the Lands
Tribunal. The amendment in clause 19 to the Lands
Tribunal Ordinance is consequential.
15. The Bill itself has no implications relating
to public expenditure or Public Service staffing
requirements. However, additional staff and public
expenditure will be involved in implementing the Air
Pollution Control (Specified Processes) Regulations
which will be made under the Ordinance. The recurrent
and non-recurrent costs are estimated to be $1.9 million
and $2.2 million respectively.
