54. The UK draft agreement at p esent includes 2 clause which 6 states that it shall apply in relation to the United Kingdom, to

7 Great Britain and Northern Ireland, and any territory for the

8 international relations of which the United Kingdom is responsible

9 and to which the Agreement shall have been extended by agreement

10 between the Parties.

As you

re aware, the draft Order in Council

11 to extend the Repatriation of Prisoners Act 1984 to Dependent 12 Territories, and which does not at present include Hong Kong, has

13 not been laid. Therefore, any agreement we may reach with the

14 Thais could unfortunately not in any case be extended to Hong

15 Kong at this stage and would not benefit the large number of HK

16 belongers and C of I holders in prison in Thailand.

17 5. We shall continue to keep you informed of progress on the

18 agreement.
