FRENCH VISA REQUIREMENT FOR HONG KONG BDTCs

1. Paris Telno 1347 refers to a Note from the French MFA asking whether the definition of a UK national for EC purposes has been amended since the UK declaration of December 1982.

It includes only 2. There has been no change in the definition. British citizens, British Subjects under Part IV of the BNA 1981 with right of abode in UK and BDTCs whose citizenship derives from a connection with Gibraltar. Hong Kong BDTCs are not UK nationals for EC purposes and it therefore seems that they need visas for France under the new French visa rules.

I attach a copy of Mr Brown's letter of 13 December 1982 and its enclosures. As far as tactics are concerned, we agree that the proposal in paragraph 2 of Telno 830 to Paris offers the best hope of averting pre-emptive action by the French on Hong Kong BDTCS.
