I have confirmed with David Seymour in our Legal Adviser's Branch that we are on safe ground if we restrict ourselves to explaining that settlement would be granted outside the Rules under the provisions of section 4(1) of the Immigration Act 1971. I suggest that you now reply in these terms. We can then sort out the practical arrangements at more leisure once I have responses to my note of 2 May.
