Explanatory Memorandum

This Bill seeks to make a number of amendments to the Pharmacy and Poisons Ordinance (Cap. 138).

Clause 2 amends the definition of—

(a) the phrase “authorized seller of poisons" to make it clear that the phrase means a business authorized to sell poisons under section 11 of the principal Ordinance;

(b) the word “dispense” to make it clear that the word includes the supply of a medicine or poison on and in accordance with a prescription and the compounding or mixing of substances including poisons and the supplying of the same; and

(c) the word “sell” in order that the restrictions imposed by the principal Ordinance in respect of the sale of substances will also apply in respect of supply and where such substances are offered or exposed for sale or supply. Clause 3 amends section 3 of the principal Ordinance by providing--- (a) for the appointment by the Governor of

(i) a person qualified in pharmacology who is on the full time teaching staff of the University of Hong Kong and nominated by them as a member of the Pharmacy and Poisons Board;

(ii) a person qualified in pharmacology who is on the full time teaching staff of the Chinese University of Hong Kong and nominated by them as a member of the Pharmacy and Poisons Board; and

(b) that the Professor of Pharmacology at the University of Hong Kong shall

cease to be a member of the Pharmacy and Poisons Board.

Clause 4 amends section 8 of the principal Ordinance by providing—

(a) for the appointment by the Pharmacy and Poisons Board, of a person qualified in pharmacology who is on the full time teaching staff of the University of Hong Kong or the Chinese University of Hong Kong as a member of the committee of examiners; and

(b) that the Professor of Pharmacology at the University of Hong Kong shall

cease to be a member of the committee of examiners.

Clause 5 repeals and replaces section 13 of the principal Ordinance to make fuller provision relating to the registration of premises under that section.

Clause 6 adds a new section 13A which enables a logo in the form prescribed under regulations to be displayed at premises registered under section 13.

Clause 7 amends section 25 of the principal Ordinance to exclude as one of the grounds on which the Board may refuse to grant an application for a listed seller of poisons licence, the fact that there are in the neighbourhood of the premises of which the applicant is occupier, sufficient facilities for the sale of poisons.

Clause 8 amends section 28 of the principal Ordinance to exempt registered medical practitioners, registered dentists and registered veterinary surgeons who maintain record cards in respect of their patients, from the requirement of recording the supply or dispensing of medicines in a separate book, provided that the details of such supply or dispensing are entered on their patients record cards.

9. Clause 9 amends section 29 of the principal Ordinance to enable the Board to make regulations relating to applications in respect of the registration of premises under section 13 and forms, fees and entries in the register of premises. Provision is also made for the form of logo which may be displayed at such premises.

10. Clause 10 amends section 30 of the principal Ordinance so as to confer jurisdiction on the Pharmacy and Poisons Appeal Tribunal to hear appeals against decisions of the Board under section 13(3) or (7).

11. Clause I amends section 36 of the principal Ordinance to extend the provision for forfeiture to any pharmaceutical product or medicine with respect to which any offence under the Ordinance has been committed.

12. The Bill will not affect the general revenue or Public Service staffing requirements.

一九八六年藥劑及毒藥(修訂)條例草案

摘要說明

本條例草案對藥劑及毒藥條例(香港法例第一三八章)作出若干項

修訂。

草案第二條規定-

(a)「認可毒藥售賣商」一短語的定義現予修訂,從而清楚說明該短語的

意思是指根據原有條例第十一條規定而獲准售賣毒藥的商號;

(b)

「配藥」一詞的定義現予修訂,從而清楚說明該詞得包括下述各涵義 即——憑着或根據一份處方供應藥物或毒藥,以及使包括毒藥在 內的若干物質化合或混合,並供應該等已化合或混合的物質;和

(c)「銷售」一詞的定義,現子修訂,從而使原有條例內就有關銷售某些 物質而制訂的限制,亦適用於供應上述物質,以及為銷售或供應目 的而提供或展示上述物質等情事。

草案第三條修訂原有條例第三條,從而規定一

(a) 總督可委任

(i) 一名具藥理學資格而擔任香港大學全職教席的人士,並獲該 校全職任教人士提名者,得出任為藥劑業及毒藥管理局委員;

(ii) 一名县藥理學資格而擔任香港中文大學全職教席的人士,並 獲該校全職任教人士提名者,得出任為藥劑業及毒藥管理局委員;和

(b) 香港大學藥理學教授停止出任為藥劑業及毒藥管理局委員。

草案第四條修訂原有條例第八條,從而規定一

(a) 藥劑業及毒藥管理局可委任一名具藥理學資格而擔任香港大學或香

港中文大學全職教席的人士為考試委員會委員;和

(b)

香港大學藥理學校教授停止出任為考試委員會委員。

五、 草案第五條撤銷原有條例第十三條條文,並另用新條文加以取代, 從而就有關該條文內載樓宇註冊事宜,作出較詳細的規定。

六、 草案第六條在原有條例內增訂新條文第十三A條,以便規定在按原 有條例第十三條規定而註冊的樓宇內能展示一個與有關規例所規定形式相同的 標誌。

七、 草案第七條修訂原有條例第二十五條,從而規定:申請人所佔用樓 字鄰近地區已有足夠的售賣毒藥設備這一事實,不再予列為藥劑業及毒藥管理 局在拒絕批准該名申請人為申領表列毒藥售賣商牌照而呈遞的申請書時所持理 由之一。

八 草案第八條修訂原有條例第二十八條,從而規定:凡已保持了有關 病人紀錄卡的註冊醫生、註冊牙醫和註冊獸醫,假如已把藥物的供應或配發詳 情分別記錄在有關病人的紀錄卡內,則獲豁免遵守須把藥物的供應或配發詳情 記錄在另一登記冊內這一規定。
