4. Section 15(3) of the principal Ordinance is

amended by inserting after "the railway" the following

"or the eastern harbour crossing",

5. The First Schedule to the principal Ordinance

is amended under the heading "Losses for which

compensation may be claimed" in items 11 and 12 by

inserting after "the railway" wherever it appears the

following

"or the eastern harbour crossing"

Explanatory Memorandum

Section 15(3) of the principal Ordinance

This

enables the proprietor of land who cannot obtain

building approval for the development of land on the

ground that the development would be incompatible with

railway works, to require the land to be resumed.

Bill extends that provision to land affected by the

construction of the proposed eastern harbour crossing

of the railway.

2. The opportunity has been taken to make an

amendment in section 3 consequential on an earlier

amendment to the Ordinance.

3. The Bill has no Public Service staffing
