Amend thead Traffic (Driving-offence Points) Ordinance.
Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.
1. This Ordinance may be cited as the Road Traffic (Driving-offence Points) (Amendment) Ordinance 1986 and shall come into operation on a day to be appointed by the Governor by notice in the Gazette.
Short title and commencement.
2. Section 7(1) of the principal Ordinance is amended by deleting "10" and Amendment of substituting the following-
"8".
3. The Schedule to the principal Ordinance is amended-
(a) in item 5 by inserting after "hour" in column 3 the following—
", other than where item 5A or 5B applies"; and
(b) by inserting after item 5 the following-

Item 5 of the Schedule to the Road Traffic (Driving-offence Points) Ordinance at present provides that if a person is convicted under section 41 of the Road Traffic Ordinance of driving in excess of a speed limit by more than 15 kilometres an hour he incurs 3 driving-offence points. The amendments in clause 3 provide for a graduated scale of points; 3 points for speeding in excess of 15 kilometres an hour, 5 points for speeding in excess of 30 kilometres an hour and 8 points for speeding in excess of 45 kilometres an hour.
2. The effect of the amendment of section 7(1) in clause 2 is that where 8 or more driving-offence points (instead of 10 or more points, as at present) have been incurred by a person, the Commissioner for Transport must serve on that person notice of the number of points that have been incurred by him, and the consequence (namely, disqualification) of acquiring 15 or more points in respect of offences which are committed within a period of 2 years.
3. The amendments in the Bill will come into operation on a date to be appointed by the Governor.
4. The Bill has no Public Service staffing or financial implications.
