Summary of Objection

Business will be affected with a decrease in daily turnover.

Loading and unloading operation to business premises will be affected by the closure.

Claimed or reserved the right to claim compensation for:

(a) the loss of business

(b) the allowances to the

employees to compensate their decrease in income

(c) difficulty in getting new tenants to the business premises

(d) the expenses to alter

the metal gates due to the raising of footpath

(e) the expenses to alter the advertising signs

Assessment of Objection

It is considered that any effect on business interests will be minimal. Also the need to improve the drainage system in the public interests out- weighs consideration of any loss of profits for a short period.

An area will be provided for loading and unloading operations.

Investigations into the Crown leases of the objectors' premises reveal that vehicular right of access has not been expressly granted in the leases. Since pedestrian access to the premises will be maintained at all times during the closure period, it would be very unlikely for compensation to be payable to the objectors under the Ordinance.

Objection withdrawn.

The objectors have not built their entrances in accordance with the approved building plans i.e. To the future footpath levels. Control and Enforcement Branch of Building Ordinance Office will take action against the owners.

This will be a minor expense. If the owners do not alter, the contractor will alter the signs at the cost of the project.
