Interference with a fishing vessel by a Chinese

armed junk in Deep Bay.

The Chinese owner and commander of a Hong Kong registered fishing vessel F.373. HC reported to the Police on 4th November that, while fishing in Deep Bay at approximately map reference 365245 about 1,000 yards from shore at 1130 hours (local time) that day he had been approached and hailed by four single-masted junks coming from Chinese territory. Seeing that one of the junks carried at least 6 men armed with rifles, he decided to run for shore. The junk then opened fire. About 30 rounds were fired and the junks pursued as far as map reference 358226. They then turned across Deep Bay and made for Chinese territory.

As far as is known, the firing came from one junk only. No uniform, flags or identification were seen on any of the junks, but the majority of the crew were dressed in dark blue overalls with dark blue cloth caps and were probably Chinese militiamen.

Two of the owner's children were injured, a boy aged 15, who received lacerated wounds on the face and legs, apparently caused by ricochet, and a girl aged 9, who received lacerated wounds on the left leg. A number of obvious bullet holes and one spent bullet were found in the vessel.

In view, however, of the ambiguous wording of the Convention of 1898 regarding use of these waters by Chinese vessels (your Savingrams No. 834 of 20th August, 1948, and No. 95 of 16th June, 1950, refer) and, in any case, the doubtful identification of the Chinese junks and crews, I do not (repeat not) consider that we should make any protest to the Chinese Government over this incident.

SENSITIVITY REVIEW OF FOREIGN AND COMMONWEALTH OFFICE RECORDS

The Public Records Acts of 1958 and 1967 provide for the transfer to the Public Record Office of all files or assembly of papers selected for permanent preserva- tion. These records then become due for release to the public 30 years after the date of the last item in the file or assembly, unless the Lord Chancellor specifi- cally authorises their withholding for a further period.

2. The function of the Sensitivity Review Unit is to identify and withhold those papers which, for various reasons, are sensitive and should not be made available to the public under the 30-year rule. Some of the reasons for withholding are:-

confidential opinions on sovereignty disputes or related matters still engaging international attention which, if disclosed now, could seriously damage the British case;

confidential correspondence with or about British firms operating continuously in sensitive areas abroad, whose disclosure now might have adverse repercussions upon current work of trade promotion;

comments by Ministers and officials on events and personalities abroad which could still be exploited by hostile propagandists or otherwise used to embroil us with foreign rulers and statesmen whose public careers have spanned the 30-year period;

documents containing information about individuals the disclosure of which would cause distress or embarrassment to living persons or their immediate descendants.

If you consider papers are sensitive for other reasons, then these should be stated in your reply.

3. On the rare occasion when it is considered that a ministerial decision should be sought a recommendation to this effect should be made to the PUS through the Head of Library and Records Department.

4. Please do not comment on papers which have not been marked for your attention.

5.

Your reply should be received in the Sensitivity Review Unit one week from the date of this minute. Should it be necessary to consult and send this minute to another Department please inform the Unit by telephone.
