An Ordinance to grant privileges and immunities in Hong Kong to the Chinese members of the Joint Liaison Group and for matters connected therewith and incidental thereto.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Privileges and Immunities (Joint Liaison Short title and Group) Ordinance 1985 and shall come into operation on a day to be appointed by commencement. the Governor by notice in the Gazette.

2. In this Ordinance, unless the context otherwise requires- "Chinese members of the Joint Liaison Group" means the persons designated from time to time by the Government of the People's Republic of China pursuant to paragraph 7 of Annex II of the Joint Declaration as its members of the Joint Liaison Group;

"Joint Declaration" means the Joint Declaration of the Government of the United Kingdom and the Government of the People's Republic of China on the Question of Hong Kong signed in Beijing on 19 December 1984;

"Joint Liaison Group" means the Joint Liaison Group established pursuant to Annex

II of the Joint Declaration.

Interpretation.

3. (1) This Ordinance shall apply to Chinese members of the Joint Liaison Application. Group.

(2) The privileges and immunities set out in this Ordinance and the Schedule Schedule. hereto shall apply to persons to whom this Ordinance applies.

4. Where any question arises whether or not any person is covered by or Evidence. entitled to any privilege or immunity under this Ordinance, a certificate issued by the Chief Secretary stating any fact relating to that question shall be conclusive evidence of that fact.

5. (1) The Second Schedule to the Air Passenger Departure Tax Ordinance is Consequential amended by inserting at the end the following-

(18 of 1985.)

"10. Passengers who are persons to whom the Privileges and Immunities (Joint Liaison Group) Ordinance 1985 applies upon production by such persons of evidence of their status in a form satisfactory to the Director.".

(2) The Dutiable Commodities Regulations are amended—

(Cap. 109, sub. leg.)

(a) in regulation 12(m) by inserting after "(Privileges and Immunities)

Ordinance 1984" the following-
