1. Legal Advisers, NTD and MVD have now commented draft letter attached to Mr Powell's minute of 26 April.

I attach a redrafted version of the letter which reflects these comments. Mr Gal Suroing, in particular has made some

Grainge very helpful points. I agree that our proposed explanatory notes about BN (0) status could combine the nationality and passport aspects. I also agree that some of the specific points in para 3 of the original draft would best be subsumed within the broader aspects which Mr Grainger has suggested.

3. I have deleted part of the third sentence and all of the fourth of para 7 of the original draft. I think this takes account of Mr Partridge's point, (para 1 (1) of his minute of 30 April), endorsed by MVD, without detracting from the argument that BN (0) S will be returnable to Hong Kong. As for the final sentence of para 8 (para 1(2) of Mr Partridge's minute of 30 April) think the answer is to delete the phrase on the basis of the terms of the agreement and exchange of memoranda". I have done this.
