EXTERNAL COMMERCIAL RELATIONS: INSTRUMENT OF ENTRUSTMENT

1. The Annex and Appendices to Mr Fifoot's Memorandum for the Law Officers on Hong Kong and the GATT refer.

2. I attach a clean draft of:

a)

the proposed Instrument of Entrustment;

b)

the complementary and confidential despatch.

Mr Fifoot agrees. If you too are content I will ask the DTI for their prompt concurrence. We will then need to send the drafts to Hong Kong for comments, before submitting them here.

3. I think the Entrustment, as it now stands, is quite adequate for GATT and сос purposes.

As for 2(c) of that draft, I explained to Mr Fifoot that the time is not yet ripe to delegate formal authority to the Govenor to conduct aviation/ shipping negotiations. When the right time comes, the terms of the accompanying despatch will enable us to give "sympathetic consideration" to such matters.
