1. In para 1 of my minute of today's date the EXCO paper generally, I said that I would be minuting separately about the draft declarations referred to in para 15 of the original text. (Para 14 of the revised).
2.
The only comment on my minute of 7 May, and attached redrafts of illustrative declarations has come from Miss Wilmshurst, Legal Adviser to ECD (E). She suggests that the word 'could' in the UK declaration might be replaced by 'shall' or 'may'. Mr Fifoot agrees with Mrs Wilmshurst that 'could' has a conditional sense which we do not intend here.
3. I think that we should try out 'may' on UKMIS Geneva when we send them the revised draft paper. We can do this in our covering explanatory telegram. 'Shall' appears to me to be inappropriate its use in the a directive to the GATT Director
