The Executive Council.

41. The Chairman of Executive Council will be called the Chief Minister. He will be nominated by the two thirds of Legislative Council who are not Government Advisers from among themselves. The Governor will endorse the nomination and the appointment will be made by the Chinese People's Government. The Chief Minister may be dismissed by the Chinese People's Government on its own initiative or by a petition of a majority of Legislative Council members who are not Government Advisers.

42. The Chief Minister will nominate other Ministers and Deputy Ministers, to head departments, for appointment by the Governor. Ministers and Deputy Ministers may be dismissed by the Governor. Ministers and Deputy Ministers may be Members of Legislative Council but need not all be members of Legislative Council. They may be foreign nationals. Government Advisers may not be appointed as ministers.

43. Posts below the level of Deputy Minister will be filled by the permanent civil service and not be political appointments or affected by changes of ministers.

44. Ministers in charge of the most important departments will sit on Executive Council. It is desirable that all these ministers be members of Legislative Council but this would not be a requirement. Those Ministers corresponding to the following branches and departments of today would, in today's circumstances, be members:-

Finance Economic Services

Law

Lands & Works

District Administration Trade & Industry Monetary Affairs Education & Manpower

Administration & Information

45. The Secretaries for Foreign Affairs, Security, and Civil Service, the Commissioner of Police and the Commissioner Against Corruption are responsible directly to the Governor. They may, with the agreement of the Governor, attend Executive Council meetings and make reports for information.
