LEGISLATIVE COUNCIL (POWERS AND PRIVILEGES) BILL

:

Part V contains a number of miscellaneous provisions. Clause 22 provides for the admissibility of the journals of the Council as evidence. (Reference should also be made to sections 10, 11 and 12 of the Defamation Ordinance (Cap. 21) relating to reports of the Council.) Clause 23 provides that the powers of the President of the Council are supplementary to any conferred on him by Letters Patent or Roya! Instructions. Clause 24 provides that the Council, the President of the Council and officers of the Council shall not be subject to the jurisdiction of the courts in respect of powers exercisable under the Bill or Standing Orders. Clause 25 confers on officers of the Council, when within the precincts of the Council Chamber, the powers and privileges of a police officer for the purposes of the Bill. Clause 26 enables the President of the Council to act even though the Council may have been dissolved. By clause 27 the consent of the Attorney General is required to institute a prosecution for an offence under the Bill. Clause 28 repeals section 4 of the Oaths and Declarations Ordinance (Cap. 11).

7. The Bill has no Public Service staffing or public expenditure implications.

本草案就立法局本身,立法局議員及立法局職員等的權力及特權, 作出規定。

二、 本草案第一部條文規定:本草案自港督在日後所定日期開始施行。

三、

草案第二部條文就立法局本身及該局議員的特權和豁免權,作出規 定。草案第三條規定:立法局享有言論及辯論自由。草案第四條賦予各議員谿 免權,從而使各議員在立法局會議或該局屬下任何委員會會議席上所發表的言 論或所提交的文件,一概免受民事或刑事訟責。根據草案第五條規定,立法局 議員在出席立法局會議或其屬下委員會會議途中,在議席上或在離開會場後歸 途上,均得免因民事债务而受拘捕。此外,在出席會議時,得免因犯刑事罪行 而受拘捕。草案第六條規定:立法局會議進行期間,當局或任何人士不得在立 法局會議廳有關範圍內送達任何有關民事訴訟的公文。該條並申明立法局議員 通常可獲豁免就任陪審員,而且亦毋須應訊在民事訴訟案中-

任證人。草案第 七條規定,倘事先未徵得立法局批准,不得就該局或該局屬下委員會任何議事 程序,在局外任何地方提述作為證供。草案第八條就非立法局成員或職員的人 士,逗留在立法局會議廳有關範圍內時的行為,有所管束;並授權該局主席笃 執行此條的規定而頒下命令,以及飭合該等人士離開立法局會議廳或立法局會 議廳的有關範圍。

四、草案第三部就出席立法局及其屬下各委員會的證人事宜,作出規定 草案第九條授權立法局或其任何常務委員會令證人出席及呈交書籍與文件 草案第十條規定:傳召證人出席的命令,須由立法局秘書發出傳票方式通 知有關證人。草案第十一條授權立法局及其屬下各委員會飭令有關證人宣毎作 供;此外,該條文並授權該局若干成員牌負監誓職責。草案第十二條規定,任 何人士如不遵從有關傳票指示,拒絕出席作供,立法局有權拘捕該人;同時, 對於該人簽保後可予以釋放的辦法,草案第十二條亦加以規定。至於草案第十 三條則規定:如一名證人奉召在立法局或其屬下委員會席上提出證供,但他對 某一項問題不願作答,或不願交出某份文件,所據理由為該問題或文件僅屬私
