The new status holders will be included in section 4 of
8. Renunciation and resumption of the new form of British
nationality.
Section 24 of the Act applies the provisions of sections 12
and 13 to renunciation and resumption of BDTC status. We shall need
to provide for people to renounce the new status if they wish,
subject to the restrictions of section 12. But we do not propose
to allow for resumption of the new status after 1 July 1997, as
this would be contrary to the UK Memorandum. There is an existing
precedent: the Act provides for renunciation of their status by
British Overseas citizens and British subjects, but it does not
provide for resumption of that status.
9.
Commonwealth citizenship.
The new form of British nationality will be included in
section 37 of the Act.
10. Deprivation of new form of British nationality.
Deprivation of citizenship is governed by section 40 of
the Act, subsection (10) of which applies its provisions to BDTCs.
Similar provision will have to be made for deprivation of the new
status under the conditions set out in section 40. In practice it
is unlikely in the extreme that the provision would ever be used.
