I have added words at the beginning of the draft submission attached to your minute of 7 December defining what we mean by "the Hong Kong Agreement".

2.

With regard to the first sentence of paragraph 4 of the submission, I could not myself confirm the assertion that none of the precedents for joint registration are directly comparable to the Hong Kong Agreement. But I wonder if the second half of that sentence (or even the whole sentence) could not simply be deleted.

3. I would not myself include the first sentence of paragraph 5 of the draft telegram. I do not know whether in practice the U.N. Secretariat would refuse to accept the deposit of the Memoranda. Their attitude in that respect might be influenced by whether the Chinese agreed or disagreed. As an alternative to this sentence you could say (although this involves a political and tactical judgment) something on the following lines

"We still consider it would be a mistake to attempt to register or deposit the Memoranda with the U.N. Secretariat, given that they are not part of the agreement and that such an attempt could well jeopardise our chances of securing Chinese agreement to joint registration.
