FUTURE OF HONG KONG: MACAU

In para 4 of

of 23 January concerning Ji Pengfei's remarks to Professor Mun Chi-kok you asked about Sir S Y Chung's assumption that changes in Macau's administrative arrangements can be initiated only by Macau. I am sorry that my response has been delayed by more pressing matters.

2. It is necessary to refer to the relevant provisions of the Organic Statute of Macau, promulgated by the Portuguese Revolutionary Council in February 1976, and also to relevant provisions of the Portuguese Constitution, promulgated in April 1976. The main relevant

relevant provisions appear to me to be as follows:-

The Statute

Article 2 'The territory of Macau is a collective person in internal public law and, bearing

bearing in mind the principles provided for in the constitutional laws of the Portuguese Republic and in the present statue, it enjoys administrative, economic, financial and legislative

economy.

Article 4 'The government bodies of the territory of Macau are the Government and the Legislative Assembly, and an Advisory Council which will be attached to the former.'

Article 5 'The legislative power will be exercised by the Legislative Assembly and the Governor.

Article 7

'The Governor will be appointed and dismissed by the President of the Republic, who will swear him in. The appointment of a Governor will be subject to consultation with the local population, namely through the Legislative Assembly and the bodies representing social interests

Article 31 1 'It is the duty of the Legislative express opinions and propose amendments
