An Ordinance to amend the Road Traffic Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Road Traffic (Amendment) (No. 2) Ordinance 1984 and shall come into operation on the commencement of the principal Ordinance.

Section 9(1) of the principal Ordinance is amended by deleting paragraph (i) and substituting the following-

"(i) the fitting, construction, operation and inspection of taxi-meters;

(ia) the design and construction of any vehicle intended for use as a private bus,

a private light bus, a public bus, or a public light bus; and".

3. The principal Ordinance is amended by adding after section 14 the following-

"Transitional provisions in regulations.

14A. Any regulation made under this Ordinance may→→

(a) provide for the continuance in force of any regulations made under the repealed Ordinance with such modifica- tions, adaptations and transitional provisions as the Gover- nor in Council sees fit; and

(b) provide for the modification, adaptation and transition of any reference in any Ordinance to the repealed Ordinance or any regulations made under the repealed Ordinance.”.

Section 27 of the principal Ordinance is amended-

(a) in subsection (4)(b) by inserting after "Ordinance” the following—

"or of any other type approved by the Commissioner"; and

(b) in subsection (5)—

(i) in paragraph (c), by deleting the full stop and substituting a semi- colon; and

(ii) by inserting after paragraph (c) the following-

"(d) any other service, which is not for hire or reward, approved by the

Commissioner.".

Section 43(4) of the principal Ordinance is amended by deleting "subsection (1)(a)” and substituting the following—

"subsection (1)”.

6. Section 51(1) of the principal Ordinance is amended in paragraph (b) by inserting after “enactment" the following--

"or the road users' code or any code of practice under section 109”.

Section 56 of the principal Ordinance is amended- (a) in subsection (1), by deleting “motor" wherever it occurs; (b) in subsection (2), by deleting "motor" wherever it occurs; (c) by inserting after subsection (2) the following—

"(2A) If, in the case of an accident referred to in subsection (1)(b), the driver of the vehicle for any reason does not give the particulars mentioned in subsection (2), he shall report the accident in person at the nearest police station or to any police officer as soon as reasonably practicable, and in any case not later than 24 hours after the accident."; (d) in subsection (3), by inserting after "person" in the first place where it

occurs the following-

"including the driver"; and

(e) in subsection (6), by inserting after "(2)" in the first place where it occurs the

following-

", (2A)".

Section 63 of the principal Ordinance is amended-

(a) by deleting subsection (1) and substituting the following-

"(1) Where the driver of a vehicle is suspected of having committed an offence under this Ordinance or, where owing to the presence of a vehicle on a road an accident occurs, any person, including both the registered owner and the person suspected of being the driver of the vehicle, shall on demand made within 6 months after the date of the alleged offence or accident give to a police officer in the manner prescribed in this section the name, address and driving licence number-

(a) in the case of an alleged offence, of the driver of the vehicle at

the time of the alleged offence;

(b) in the case of an accident, of the driver of the vehicle at the time of the accident or of the last driver of the vehicle prior to the accident,

and his relationship, if any, to any such driver.":

(b) in subsection (3)—

(i) in paragraph (a) by inserting after "offence" the following-

"or accident, or was the last driver of the vehicle prior to the accident": and

(ii) in paragraph (b) by inserting after "offence" the following-

"or accident, or was not the last driver of the vehicle prior to the accident";

(c) by deleting subsection (4)(a) and substituting the following-

"(a) to furnish, within 21 days after the date of the notice, to a police officer specified therein, a written statement, in such form as may be specified in the notice, giving the name, address and driving licence number-

(i) in the case of an alleged offence, of the driver of the vehicle at the time of the alleged offence;

(ii) in the case of an accident, of the driver of the vehicle at the time of the accident or of the last driver of the vehicle prior to the accident,

and his relationship, if any, to any such driver; and”;
