An Ordinance to amend the Firearms and Ammunition Ordinance.

[27 July 1984]

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Firearms and Ammunition (Amend- ment) Ordinance 1984.

Section 13(2) of the principal Ordinance is amended by deleting "10 years" and substituting the following-

"14 years".

3. Section 16(2) of the principal Ordinance is amended by deleting "14 years" and substituting the following-

"life".

4. Section 17(1) of the principal Ordinance is amended by deleting "14 years" and substituting the following-

Section 18 of the principal Ordinance is amended-

(a) in subsection (3) by deleting "14 years" and substituting the following---

"life":

(b) by inserting after subsection (3) the following-

"(4) No prosecution for an offence under subsection (1) shall be instituted without the consent of the Attorney General but this sub- section shall not prevent the arrest, or the issue of a warrant for the arrest, of a person for any such offence.

(5) If in proceedings for an offence under subsection (1) the defendant is acquitted but it is proved that he is guilty of an offence under section 20 he shall be convicted of the offence under section 20 and shall be punishable accordingly notwithstanding that there is no consent to prosecute in accordance with subsection (3) of that section.".

Section 21(2) of the principal Ordinance is amended by deleting "5 years" and substituting the following-

"14 years".

7. The Second Schedule to the Magistrates Ordinance is amended in item 2 of Part III by deleting "or section 17, 28 or 29 of the Offences against the Person Ordinance" and substituting the following-

", section 17, 28 or 29 of the Offences against the Person Ordinance or section 16, 17 or 18 of the Firearms and Ammunition Ordinance".
